Is it illegal to have a mistress if she is the wife's daughter?

Q. My mom's husband got my sister (his step daughter) pregnant and she had his child 7 years ago, she rents a one bedroom unit in the backyard. My mom and her husband also have two younger children (1 & 4). He sometimes stays with my sister and their kid overnight in the unit.

I know this is wrong but is it illegal? My sister is 22, mom is 47.
