Can a mother move kids to another state preventing visitation rights of a father?

My ex-wife threatened to move our kids to another state 1000 miles away unless I pay more child support on the basis that she cannot support the kids and herself unless she continues to stay in her parents home which they recently bought in another state. Although she is the custodial parent of my 2 and 5 year old daughers, I do have joint legal custody and alternate weekends. This would make it nearly impossible to visit my children and be apart of their lives. Although I will discuss with my attorney does anyone have experience or know if the State would allow this? Do I file a motion?

Wow you got some dud answers that didn't answer your questions! Okay, first off she can not threaten you like that, that is called extortion and is illegal. If she can't support the children on what she makes and your child support and any government assistance that is available to her then she shouldn't have custody of the children! Perhaps she needs to understand that people on a fixed income don't wear Nike shoes and go out to the movies! They also can't buy 3 bedroom homes! She can find somewhere in a 25 mile radius where her and the kids can live and she can afford it, even if it is a 2 bedroom apartment with low income housing. Just because she has ideas of how she should be living and able to buy for herself and the children, doesn't mean that is actually what she should be able to buy. MANY people either get 2 or 3 jobs to make ends meet or they live within their means which might mean the total grocery budget is $50 for a family of 4 for the entire week, sure you don't get steak, but you can still make some very good meals! to sum up, her inability to make money is not your fault and not your problem, she can't make you pay more than the the state says you should.

She would need your permision to move that far away, or the courts permission. I don't care if she promises to fly the kids to you every weekend, DO NOT give her permission. As long as you are active in the children's lives and the court sees that it isn't like she got a 100K job offer 1000 miles away she just doesn't want to live within her means, well the Judge won't give permission either! But I am concerned about one thing...do you have joint legal custody and court ordered visitation, because if your order doesn't actually read that you get specific days and times, or that you maybe have joint physical custody too then you might have a glitch.

If by some weird fluke she does move 1000 miles away with the kids, you have 6 months to file your custody petition. What you would be filing is for primary custody because she has blocked your access to your children, and you are active in their lives. In most cases like this, especially considering what she is saying to you, the Judge will give her 2 choices, either move back with the kids, or hand over custody of the kids to the father, since you CHOSE to move.

Anyway, you have 6 months for your state to hold the jurisdiction over the case, after that all the court stuff would be held in her new state and county. And if you are seeing them frequently I would head back to court and file for joint physical custody....and tack on a small statement about "If the primary parent moves more than 50 miles from their current location at XXX main Street, blah, NJ, then primary custody will revert to the father."

People add in little things like that all the time!

Moved some furniture around, and now there's a big blank wall behind the couch. I'm on a college budget, so I'd like to use mostly supplies I already have; several colors of paper, markers (including silver), scissors, tape, etc. I'm ok with spending a LITTLE money on supplies as well.
